Please read this End-User License Agreement ("EULA" or "Agreement") carefully before using the BlastCAD software platform and website operated by us. This Agreement governs your access to and use of the software.
By accessing, registering for, or using BlastCAD, you agree to be bound by this EULA. If you do not agree to the terms of this Agreement, do not access or use the software. If you are using BlastCAD on behalf of an organization or company, you represent that you have the legal authority to bind that organization to these terms.
Subject to your continuous compliance with this Agreement, BlastCAD grants you a limited, non-exclusive, non-transferable, revocable license to access and use the BlastCAD platform solely for your internal drill and blast engineering purposes. During the public beta phase, the service is provided free of charge. We reserve the right to introduce paid subscription plans in the future, with reasonable prior notice provided to existing users.
BlastCAD is a professional engineering software tool designed exclusively to assist qualified mining engineers, blasters, and industry professionals. While our embedded analytics (such as Kuz-Ram, Attewell-Farmer, Lundborg, etc.) are based on established scientific literature, they represent theoretical mathematical approximations and simulations.
You agree not to misuse the software. Under this license, you strictly shall not:
You are responsible for safeguarding the credentials you use to access the service. We strongly encourage enabling the Two-Factor Authentication (2FA) feature. The drill data, CAD files, explosive configurations, and project content that you upload remain entirely your intellectual property. You grant BlastCAD only the limited rights necessary to host, process, and render that content to provide the service back to you.
The software platform, its architecture, UI/UX design, underlying predictive models, and the "BlastCAD™" name, brand, and associated logos are and remain the exclusive intellectual property of BlastCAD and its licensors. This Agreement does not grant you any rights to use our trademarks or branding.
The software is provided strictly on an "AS IS" and "AS AVAILABLE" basis, particularly during the public beta period. To the maximum extent permitted by applicable law, BlastCAD disclaims all warranties, whether express, implied, statutory, or otherwise, including but not limited to any warranties of merchantability, fitness for a particular purpose, accuracy of outputs, and non-infringement. We do not warrant that the software will be uninterrupted, error-free, or entirely secure.
In no event shall BlastCAD, its developers, directors, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, loss of data, operational downtime, or any property damage or personal injury resulting from reliance on the software's outputs. Your use of the software is entirely at your own risk.
This Agreement is effective until terminated by you or BlastCAD. You may terminate it at any time by deleting your account and ceasing all use of the software. We may suspend or terminate your access immediately, without prior notice or liability, if you breach any material provision of this EULA.
This Agreement shall be governed and construed in accordance with the laws of Western Australia, Australia, without regard to its conflict of law provisions.
We reserve the right, at our sole discretion, to modify or replace this EULA at any time. Where changes are material, we will provide at least 30 days' notice prior to any new terms taking effect via an email notification or a prominent notice within the software application.
